These Terms of Use ("Terms") govern your access to and use of MS Buddy ("the App"), operated by SJB Digital Ventures LLC, doing business as MS Buddy ("MS Buddy," "we," "us," or "our"). By using the App, you agree to be bound by these Terms and our Privacy Policy (collectively, "this Agreement"). If you do not agree, you must not use the App.
By downloading, accessing, or using MS Buddy, you agree to be bound by these Terms of Use and our Privacy Policy. If you do not agree to these terms, you must not access or use the App.
MS Buddy is designed for use by individuals who are 18 years or older. By using the App, you represent and warrant that you are at least 18 years of age.
Not for Minors: MS Buddy is not intended for use by individuals under the age of 18. We do not knowingly collect or store personal information from minors. In compliance with COPPA (Children's Online Privacy Protection Act), if we discover that we have inadvertently collected information from a child under 13, we will delete it immediately.
Parental Responsibility: If you are a parent or guardian and become aware that your child has provided us with personal information, please contact us at support@mymsbuddy.com so we can promptly delete the data.
MS Buddy is a personal wellness tracking tool only and is NOT a medical device, diagnostic tool, or clinical monitoring system. The App cannot:

Do not rely on this app during a medical emergency. Do not delay seeking medical attention because of anything you have read or tracked in this App.
You acknowledge and agree that MS Buddy is a personal wellness journal and tracking tool. It is not a medical device, clinical monitoring system, or diagnostic tool. The App has not been evaluated, cleared, or approved by the U.S. Food and Drug Administration (FDA) or any equivalent regulatory body in any jurisdiction. The App is not intended to be used in the diagnosis of disease or other conditions, or in the cure, mitigation, treatment, or prevention of disease.
You agree not to use the App as a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of your physician or other qualified healthcare provider with any questions you may have regarding a medical condition. Any wellness trends, patterns, summaries, or reports generated by the App are for your personal informational use only and should not be interpreted as clinical data.
MS Buddy is not a HIPAA-covered entity and is not intended to serve as a medical records system or electronic health record (EHR). While we take the security of your health-related data seriously and implement strong safeguards (described in our Privacy Policy), the protections provided by HIPAA do not apply to the data you store in MS Buddy. You should not use MS Buddy as a substitute for medical records maintained by your healthcare providers.
By using the App, you expressly acknowledge and assume all risks associated with the use of a personal wellness tracking tool, including but not limited to:
You agree that MS Buddy shall not be liable for any harm, injury, or damage resulting from your reliance on information provided by the App or your use of the App's features.
Certain features of the App — including news article summaries, research highlights, facility and provider narratives, and facility patient-experience scores — use artificial intelligence (AI) to generate content. You acknowledge and agree that:

Account Security: You are responsible for maintaining the confidentiality of your account information and password.
Accurate Information: You agree to provide accurate and complete information when creating an account.

All content, features, and functionality (including but not limited to text, graphics, logos, and software) are the exclusive property of SJB Digital Ventures LLC and are protected by copyright, trademark, and other intellectual property laws.
You retain ownership of all personal data you input into the App. We process this data solely as permitted by this Agreement and applicable law. You grant us a limited license to use your data for the express purpose of providing and improving the App's services.
In plain language: We are not financially responsible for damages that arise from your use of the App, to the extent the law allows.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL SJB DIGITAL VENTURES LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES (COLLECTIVELY, "MS BUDDY") BE LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL DAMAGES, OR ANY DAMAGES WHATSOEVER INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF USE, DATA, OR PROFITS, PERSONAL INJURY, OR ANY DAMAGES ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE USE OR PERFORMANCE OF THE APP, WITH THE DELAY OR INABILITY TO USE THE APP, THE PROVISION OF OR FAILURE TO PROVIDE SERVICES, OR FOR ANY INFORMATION, SOFTWARE, PRODUCTS, SERVICES AND RELATED GRAPHICS OBTAINED THROUGH THE APP, OR OTHERWISE ARISING OUT OF THE USE OF THE APP, WHETHER BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY OR OTHERWISE, EVEN IF MS BUDDY HAS BEEN ADVISED OF THE POSSIBILITY OF DAMAGES. THIS LIMITATION SPECIFICALLY INCLUDES, WITHOUT LIMITATION, ANY DAMAGES ARISING FROM HEALTH-RELATED DECISIONS MADE BASED ON INFORMATION DISPLAYED IN OR GENERATED BY THE APP, INCLUDING AI-GENERATED CONTENT AND DATA IMPORTED FROM THIRD-PARTY SOURCES.
In plain language: The App is provided as-is without guarantees about its performance.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. MS BUDDY HEREBY DISCLAIMS ALL WARRANTIES AND CONDITIONS WITH REGARD TO THE APP, INCLUDING ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. MS BUDDY MAKES NO WARRANTY THAT:
You agree to indemnify, defend, and hold harmless SJB Digital Ventures LLC, its officers, directors, employees, agents, and third parties, for any losses, costs, liabilities, and expenses (including reasonable attorney's fees) relating to or arising out of your use of the App, your violation of this Agreement, your violation of any rights of a third party, or your violation of any applicable laws, rules, or regulations.
Any disputes arising out of or relating to this Agreement shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association ("AAA"), subject to the following:
We reserve the right to terminate or suspend your access to the App, with reasonable notice when practicable, for any reason, including breach of this Agreement.
Your Data Upon Termination: If your account is terminated, you will have 30 days from the date of termination notice to request a copy of your data by contacting support@mymsbuddy.com. After this 30-day period, your data will be deleted in accordance with our Data Retention policy.
Voluntary Account Deletion: You may delete your account at any time from your Profile page within the App. When you delete your account, your personal information (username, email, and login credentials) is permanently removed, and your health data is anonymized so it can no longer be linked to you. If you would like a complete deletion of all data including anonymized records, contact support@mymsbuddy.com before deleting your account.
MS Buddy shall not be liable for any failure or delay in performance resulting from causes beyond its reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, labor disputes, government actions, internet or infrastructure failures, or third-party service outages.
MS Buddy is operated from the United States by SJB Digital Ventures LLC. If you access the App from outside the United States, you do so at your own initiative and are solely responsible for compliance with local laws. We make no representation that the App is appropriate, available, or legally compliant for use in any particular jurisdiction outside the United States. The App has not been designed to comply with the health data, medical device, or consumer protection regulations of any country other than the United States.
This Agreement shall be governed by and construed in accordance with the laws of the State of Illinois, without regard to its conflict of law provisions.
We reserve the right to modify these Terms at any time. We will provide notice of material changes at least 30 days before they take effect, via in-app notification or email. Your continued use of the App after the effective date signifies your acceptance of the updated Terms.
SJB Digital Ventures LLC may assign or transfer this Agreement, in whole or in part, without restriction. You may not assign or transfer any rights or obligations under this Agreement without our prior written consent.
This Agreement does not confer any rights, remedies, or benefits upon any person or entity other than you and SJB Digital Ventures LLC.
If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
The App includes directory features that display information about MS care facilities, healthcare providers, and clinical trials. This information is aggregated from publicly available sources, including the NPI Registry, CMS Medicare data, Open Payments, ClinicalTrials.gov, facility and organizational websites, and similar public datasets, and may be supplemented by AI-generated summaries, tags, rankings, and patient-experience scores. This Agreement, together with our Privacy Policy, constitutes the entire agreement between you and SJB Digital Ventures LLC regarding the App and supersedes all prior agreements.
